This determination considers an authority’s purported decision to refuse to grant a building consent for a new dwelling with a proposed bamboo cladding system.

The reasons for the purported refusal come from the authority’s requests for further information and correspondence and relate to a BEAL appraisal certificate provided in respect of the bamboo cladding system.  

This determination considers whether a territorial authority was correct to issue a notice to fix for building works that involved the alterations and modifications of an existing specified system – an automatic sprinkler system – where a building consent was not obtained prior to the works commencing. The determination also considers if the building works could have been undertaken in accordance with clause 10 of Schedule 1 of the Building Act.

This determination considers the authority's decision to issue a code compliance certificate in respect of a mechanical ventilation system for the fitout of a restaurant; the extract from the restaurant's kitchen exits the building via existing exhaust ductwork, and other building occupants consider the kitchen’s exhaust discharge to be a nuisance.

The determination considers the compliance of the kitchen ventilation system as designed and as built, and the compliance of the existing exhaust ductwork and discharge point.

The determination considers whether zero pitch protected liquid-applied membrane roofs will comply in regards to weathertightness and durability if constructed as specified by the manufacturer. The determination provides analysis of the evidence in support of the membrane in this use, sets out the design parameters for buildings for which the waterproof membrane would be used, and discusses drainage, resistance to water, and whether there is reliance on other components of the roofing system.
