2026/026: An authority’s decision to issue a notice to fix for a change of use of a unit

This determination is subject to appeal.

This determination considers an authority’s decision to issue a notice to fix, for a contravention of sections 114 and 115 of the Act, to the owners of a unit in a multi-unit residential building complex being let as short-term holiday accommodation.

The determination considers whether a change of use has occurred, in particular whether the unit’s classified use under Building Code Cause A1 Classified Uses has changed from ‘Multi-unit dwelling’ to ‘Community service’.
