2024/006: The refusal to issue a certificate of acceptance for building work associated with a dwelling

This determination considers the authority's refusal to issue a certificate of acceptance for building work associated with a dwelling, that was carried out without building consent. The authority considered that Building Code clauses B1 Structure, B2 Durability, E2 External Moisture, G2 Laundering, G9 Electricity, G12 Water Supplies and H1 Energy Efficiency were not met. The determination considers the reasons for refusal set out in the authority’s refusal letter and subsequent report.

Making buildings more affordable by changing Building Code insulation requirements

The Ministry of Business, Innovation and Employment (MBIE) is reducing the costs of complying with Building Code insulation requirements, referred to as ‘H1 insulation requirements’, by removing the Schedule Method.

2019/061: Regarding the compliance of a surface water drainage connection

This determination considers whether a surface water drain complies with Building Code Clause E1 Surface water: the drain collects water from a roof and is connected to a kerb sump and not directly to a surface water drain.  The authority considers the connection to the sump was contrary to the means of compliance stated in the building consent, being the Acceptable Solution for Clause E1, and that approval should be sought for the work as a minor variation to the consent.
