This determination considers an authority's decision to refuse to issue a Code Compliance Certificate for a building consent granted in 2000 under the former Building Act 1991. The determination will discuss the reasons given by the authority for the refusal, and how they relate to Building Code clauses B1 Structure, B2 Durability, E2 External moisture that applied in 2000.

This determination considers whether alterations to the walls and roof of a house comply with Building Code Clauses B1 Structure, E2 External moisture and F7 Warning systems. The determination also considers whether changes to the consented building work can be considered a minor variation to the building consent, and the issue of the code compliance certificate for the alterations.

This determination considers a notice to fix issued for the rebuilding, without a building consent, of a small extension or lean-to attached to a house. The matter turns on whether the components or assemblies replaced in the rebuilding of the structure were in the same position such that they were exempt under Schedule 1from the requirement for a consent, and whether the notice to fix was correctly issued.

This determination concerns the refusal to issue a code compliance certificate on the grounds that the authority could not be satisfied that the building work complied with Clause B1 Structure.  The as-built work differed from that described in the building consent, which been supported by the specifications and design documentation for a proprietary construction system that was not used in the construction of the building.

This determination considers the requirements under Clause H1.3.4 in regards to insulation of a TPR valve and a length of hot water pipework, and Clause G9 in regards to the location of an electrical cable in a duct with the water supply pipework. The determination discusses the application of the relevant Acceptable Solutions and associated Standards as a means of establishing compliance.

This determination considers whether the proposed installation of bedroom door locks at a residential housing facility, which alters the building’s means of escape from fire, complies with Building Code clause C4 Movement to a place of safety.

It also considers clause A1 Classified Uses to identify the extent to which the building must comply with C4.
