Reviewing the operation of the Plumbers, Gasfitters and Drainlayers Act

The Ministry is conducting a survey of plumbers, gasfitters drainlayers to find out whether the Act is supporting them in their day-to-day work and to find out how it could be improved.

If you are a plumber, gasfitter or drainlayer we invite you to complete the survey and to give us your thoughts. Your comments and feedback are important to us and will be used to inform the review.

Improving the occupational regulation of engineers

We are keen to hear what you think of proposals to change the occupational regulation of engineers. The changes are about reforming the way professional engineers are regulated to ensure they have the right skills and knowledge for the work they do, and that we improve the public accountability of engineers where they do not match up to accepted professional standards.

The changes we’re suggesting include:

  • a legal requirement for suitably qualified and experienced engineers to design significant and complex buildings;
  • developing a robust system to properly hold engineers to account when their work is substandard;
  • introducing greater rigour in the assessment of chartered professional engineers and to be more specific about an engineer’s areas of competency;
  • better checks and balances in the system of regulating engineers to ensure the public interest is served.

The changes are described in detail in the consultation document. The consultation period runs from 4 September 2014 until 31 October 2014.

Changes to Acceptable Solutions and Verification Method for Protection from Fire and Backcountry Huts

MBIE seeks your comment on:

  • urgent amendments made to the Acceptable Solutions C/AS1 – C/AS7 and Verification Method (C/VM2) on 19 December 2013, which are now being consulted on, and
  • further proposed changes to the Acceptable Solutions C/AS1 – C/AS7 and Verification Method (C/VM2) for Protection from Fire, and
  • proposed minor changes to the Acceptable Solution for Backcountry Huts, BCH/AS1

Keeping our dams safe

Keeping our dams safe consutlation cover. We seek comments on the proposed definitions of seven key terms relating to the dam safety scheme. Each of the terms is necessary for the effective operation of the scheme when it comes into effect on 1 July 2014.

Your feedback on the proposed definitions is important, as MBIE wants to ensure that each definition is as clear and comprehensive as possible.

The proposed definitions fall into two categories:

  • those that determine which dams will be subject to the dam safety scheme, based on size, volume, and location
  • those which identify dams as dangerous, earthquake-prone, or flood-prone.

The consultation document sets out the detail of the proposed definitions and provides questions to prompt discussion on possible responses. The consultation period runs from 26 August 2013 to 7 October 2013.

Making pool safety easier

Making pool safety easier cover. We are keen to hear what you think of our ideas for changing pool fencing rules. The changes are aimed at keeping young children safe around home pools, while making the rules less costly for pool owners and local councils to comply with.

The changes we’re suggesting include:

  • people getting a new pool would have simpler and more flexible rules for restricting young children’s access to the pool
  • pool owners would do a maintenance check every three years and give it to their local council
  • spa pools with a childproof cover would not need a fence
  • portable pool retailers would need to tell buyers about their safety obligations when they buy a portable pool over the height of 400mm
  • the term ‘swimming pool’ would be limited to pools intended for swimming or similar activity. This changes the current definition which includes other water hazards such as garden ponds.

Building Seismic Performance

Building Seismic Performance cover. The Ministry is consulting on proposed changes to the system for dealing with earthquake-prone buildings. The proposals set out a consistent national approach to dealing with these buildings.

Essentially the proposals would require all non-residential and multi-unit, multi-storey residential buildings to have a seismic capacity assessment done within five years. Owners of buildings identified as earthquake-prone would then have up to 10 years to strengthen or demolish these buildings.

Unit Titles Amendment Bill

Unit titles amendment bill consultation cover The Ministry is consulting on proposed amendments to the Unit Titles Act 2010 and Unit Titles Regulations 2011, to be addressed by the Unit Titles Amendment Bill (UTAB).

The discussion document details the proposed amendments for inclusion in the UTAB. We invite you to consider these amendments, and to provide comments.

If you are aware of other sections of the Act or Regulations which in your view contain minor and technical issues, we also invite you to bring these to our attention.

LBP policy issues

Retirement Villages Code of practice 2008 consultation. The Ministry of Business, Innovation and Employment is consulting on licensed builder practitioner (LBP) policy issues. This consultation asks for your comments on five issues:

  • What should the role of the site licence be going forward?
  • Should the Site licence be split into a 'technical supervision' licence and a 'project manager' licence?
  • Should any new licences be developed?
  • Do any of the current licence competencies and performance indicators need to be amended?
  • Should any work that is currently RBW be specifically excluded from being RBW?

A number of workshops, where you can discuss these issues with other practitioners and provide feedfback, are being held around the country.

Deeming of Plumbers and Gasfitters as LBPs

Updating standards cover.The Ministry of Business, Innovation and Employment is consulting on whether the 'deeming' provision for registered plumbers and gasfitters as LBPs should be removed. This provision, which came into effect in 2012, has raised some concerns. The consultation asks for your comments on these concerns, the several options that have been considered, and the preferred option of removing the 'deeming provision'.

Proposed variations to the Retirement Villages Code of Practice 2008

Retirement Villages Code of practice 2008 consultation.The Retirement Commissioner and the Ministry are consulting on proposed variations to the Retirement Villages Code of Practice 2008 (the Code).

This joint consultation asks for your comments on the proposed variations to the Code of Practice. These concern no-fault exit situations in Retirement Villages such as that which occurred as a result of the Canterbury Earthquakes.

Seismicity changes for Canterbury to B1 Structure documents

Updating standards cover.
            Seismicity changes for Canterbury to B1 Structure documents cover. We propose to confirm changes made under urgency for the Canterbury earthquake region on 19 May 2011 to the Building Code’s supporting documents for Structure (Building Code clause B1). The changes increased the minimum seismic hazard factor for Canterbury and required stronger foundations for buildings.

B1 (Structure) proposals

B1 Structure consultation cover. We propose to cite the next version of the widely-used timber-framed buildings standard NZS3604; cite new standards for steel-framed housing and low-rise buildings (NASH), and seismic restraint of engineering systems in buildings (NZS 4219:2009); and delete an Acceptable Solution for timber barriers.
